The landowner, if private, has three (3) options for responding to an application for a Mining operation permit for Quarry Substances on his property:
- refuse the application;
- sell his property to the applicant;
- make his property available to the applicant for a specified period under conditions specified in an implementing decree of this Code.
If the land is within the private domain of the State, the State may deny or make this land available for a fixed period of time and under conditions specified in the implementing decree.
If the site ceases to be available for any reason, the landowner is entitled to require that the site be restored. However, if the availability ceases due to the fault of the owner, the landowner must pay compensation for eviction to the operator.
