Article 127: Authorisation to Third Parties and Non-Compensation

Any person who performs works, constructs buildings or installs moveable facilities within the area of an Operating Permit or Mining Concession, must obtain prior authorisation from the Minister in charge of Mines, after receiving a reasoned opinion from the relevant administrations, as applicable; unless these works, buildings or facilities are intended for mining operations and are initiated or established by the holder of the Mining Title or by such person.

Damage caused by mining operation activities to the works, buildings and facilities undertaken or established without this special authorisation shall not give rise to compensation.
