Subject to applicable law, the holder of a Mining Title has access to and may use the roads, bridges, airfields, port infrastructure and railways, related transport infrastructure or other, as well as water lines and electricity lines or communication channels, established or developed by an organ or entity owned or controlled by the State, except the Armed Forces, without having to pay fees exceeding those paid by Guinean citizens and other foreign persons, if any. The holder is, however, liable for any repairs or costs of rehabilitation of the infrastructure owned by the State, resulting from use exceeding the normal wear and tear of these facilities. “Normal wear and tear” means use corresponding with the use of other users in a comparable situation.
Lines of communication established or developed by the holder of a Mining Title within or outside the area of such Title, may be used by the State or by the third parties who request it, provided that such use does not result obstruct or substantially interfere in the activities of the holder.
The terms of this use will be defined by agreement with the parties involved.
