All individuals or legal entities with the necessary technical and financial capability to successfully complete the activities in question may undertake staking for indications, exploring for Mine or Quarry Substances, subject to the conditions set out in this law.
Subject to the provisions of this law, Mine or Quarry Substances may be exploited by the following:
- any individual or legal entity constituted as a public or private corporation under Guinean law, having the technical and financial capability to undertake the requested operation;
- any individual or legal entity of Guinean nationality who is duly authorised to carry out semiindustrial or artisanal operations.
A decree of the President of the Republic of Guinea shall specify the content of what is meant by “Technical and financial capability”.
Mining Titles or Authorisations may not be granted to individuals or companies subject to international sanctions or criminal investigations relating to fraud, corruption or money laundering.
