In the event where the holder of a Mining Title Permit or Authorisation fails to draft the regulations referred to in Article 145 above, the Minister in charge of Mines may, after hearing the holder’s submissions, prescribe by order on recommendation of the National Mining Authority, measures required to ensure the health and safety of workers.
In case of emergency or imminent peril, the National Mining Authority may prescribe provisional measures pending issuance of the order described in the preceding paragraph.
In any event, a holder is obliged to take the prescribed measures within the delays stipulated. Failure to do so results in such measures being automatically implemented by the National Mining Authority, on its own initiative and at the holder’s expense.
