Article 155: Code of Good Conduct

Any individual or legal entity possessing a Mining Title, providing an application for a Mining Title, negotiating mining rights with the Ministry in charge of Mines or any other organ of the Guinean Government, or participating in a call for tenders for a Mining Title, will sign a Code of conduct with the Minister specifying at least:

  • its commitment to comply with Guinean laws, including the provisions of this Code relating to the prohibition on the payment of Bribes;
  • its commitment to cooperate with the Guinean Government or Parliament in connection with any investigation of alleged violations of the provisions of this Code relating to the prohibition on the payment of Bribes by companies; and
  • its commitment to comply with the twelve principles of the Extractive Industries Transparency Initiative (EITI).

Failure to sign such a Code of Conduct will result in the exclusion of such an individual or legal entity from the grant of a mining Title.

Codes of conduct that have been signed must be published in the Official Gazette and on the official Website of the Ministry in charge of Mines or any other site designated by the Minister.
