Article 207: Failure to Obtain an Authorisation to Operate

Anyone who carries out exploration, work or mining operation of a Mine or Quarry without a Mining Title or Authorisation, or beyond the limits of its Title or of its Authorisation, or who undertakes mining operation work with an Exploration Permit, will be punished with imprisonment of two months to three years and a fine of ten million (10,000,000) GNF to fifteen million (15,000,000) GNF or one of the two sentences only.

The above fine will be twenty million (20,000,000) GNF to thirty million (30,000,000) GNF if the substances in question are diamonds or other gems.

The conviction will result in the State seizing the proceeds of the fraudulent operations as well as the instruments used for the fraudulent operation.

This fine is tripled and the prison sentence doubled for any subsequent offence.
